Welcome to CureNet. These Terms of Service ("Terms") govern your access to and use of the CureNet mobile application, website, and associated services (collectively, the "Services") provided by Jeevant AI Technologies Pvt. Ltd. ("Jeevant", "we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old and a resident of India to create an account. If you are under 18, you may only use the Services with the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf.

2. Description of Services

CureNet provides a personal health record management platform that allows users to:

  • Scan and digitize physical medical documents (prescriptions, lab reports).
  • Extract structured data from these documents using Artificial Intelligence.
  • Connect to the Ayushman Bharat Digital Mission (ABDM) to create an ABHA ID and sync digital records.
  • Store records locally in an encrypted format.
  • Use an AI assistant ("ABHAy") to query and understand their personal health data.

3. CRITICAL MEDICAL DISCLAIMER

CURENET IS NOT A HEALTHCARE PROVIDER. The Services, including the ABHAy AI assistant, are designed for informational and record-management purposes only.

No Medical Advice: Nothing contained in the Services should be considered, or used as a substitute for, professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Emergency Situations: Never disregard professional medical advice or delay in seeking it because of something you have read on or extracted via CureNet. If you think you may have a medical emergency, call your doctor or emergency services immediately.

4. AI Limitations and Accuracy Disclaimers

  • OCR and Extraction: The Services utilize Optical Character Recognition (OCR) and Large Language Models (LLMs) to extract text from physical documents (especially handwritten prescriptions). While we strive for accuracy, AI models can make errors ("hallucinations" or misread text).
  • User Verification Required: You are strictly required to review and verify all data extracted by the AI against your original physical document before saving it to your health record. Jeevant is not liable for any adverse health outcomes resulting from unverified, inaccurate, or hallucinated data.
  • ABHAy Assistant: The AI assistant generates responses based solely on the documents you have uploaded. It does not have context beyond what is in your digital record. It cannot diagnose conditions or prescribe medications.

5. User Responsibilities

By using the Services, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your device and biometric authentication methods. You are responsible for all activities that occur under your account.
  • Ensure that any documents you upload belong to you or a dependent for whom you have legal authority to manage health records.

6. ABDM Integration Terms

CureNet is integrated with the Ayushman Bharat Digital Mission (ABDM) infrastructure. By linking your ABHA ID to CureNet, you agree to the National Health Authority's (NHA) Health Data Management Policy. You acknowledge that sharing data with healthcare providers via ABDM is done strictly upon your generation of a digital Consent Artifact.

7. Acceptable Use Policy

You agree NOT to:

  • Upload documents containing malicious code, viruses, or illegal content.
  • Attempt to reverse-engineer, decompile, or hack the CureNet application or backend APIs.
  • Use the Services to store records belonging to an adult individual without their explicit, legally valid consent.

8. Intellectual Property

All rights, title, and interest in and to the Services (excluding user-provided health records), including software, algorithms, designs, logos, and trademarks, are and will remain the exclusive property of Jeevant AI Technologies Pvt. Ltd.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JEEVANT AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
  2. INACCURATE MEDICAL DATA EXTRACTION OR MEDICAL DECISIONS MADE BASED ON APP DATA;
  3. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless Jeevant AI, its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of the Services or your violation of these Terms.

11. Modification of Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the app. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in Jaipur, Rajasthan, under the Arbitration and Conciliation Act, 1996.
